1.1 Introduction

Trademark Search Pro (the "Software" or "Platform") is provided by Meerad Business Solutions ("Meerad", "we", "us"). By accessing or using the Software, you ("User") agree to these Terms & Conditions ("Terms").

By purchasing a subscription, you confirm that you have read, understood, and agreed to:

If you do not agree to these Terms, do not use or subscribe to the Software.

1.2 Intellectual Property

All software code, content, designs, logos, documents, reports, and other material available on or via the Software (“Site Elements”) are the property of Meerad or its licensors.

Users are granted a non-exclusive, non-transferable, limited license to use the Software according to their subscription plan.

Users may not copy, reproduce, distribute, or exploit the Software or Site Elements beyond the scope of this license.

1.3 Subscription, Payment, and Refund Terms

Annual Subscription: Subscription fees are charged annually. No monthly subscription plans are available.

No Refund Policy: Subscription fees are strictly non-refundable, including accidental deletion, cancellation, or technical issues.

Demo Recommendation: Users are strongly advised to use the demo before purchasing a subscription.

Upgrades: Users upgrading to a higher plan mid-term will have pro-rated fees adjusted toward the new plan, excluding GST, which is non-refundable.

Account Ownership & Use:

Individuals may manage their own or authorized family trademarks.

Firms/Companies may manage parent, subsidiary, or group company trademarks only.

Professionals may manage only client trademarks, and cannot contact proprietors outside authorized scope.

1.4 Data Access and Update Mechanisms

1.4.1 Manual Updates

Users may trigger trademark data updates via a button in the Software.

The Software will prompt the user to enter OTPs sent to registered mobile numbers.

IP India may limit the number of applications per session or session duration (5–15 minutes).

Users may need to provide multiple mobile numbers for large portfolios.

1.4.2 Automatic Updates

Users may install a companion mobile app to read OTPs automatically for trademark data updates.

Users acknowledge and agree to indemnify Meerad, its group companies, staff, developers, and stakeholders from any liabilities arising from:

Data loss

Unauthorized access to the mobile device

Errors, delays, or failures in automatic updates

1.4.3 IP India Login Credentials & Email Synchronization

Users may choose to provide their IP India login credentials, which the Software will use to fetch important notifications and updates of their trademark applications.

Users may grant permission to synchronize their email accounts with the Software to track IP India emails for updates.

Users understand that these features are optional and agree that Meerad is not liable for any failure or delay in updates.

1.4.4 No Scraping / Data Access Restriction

Users must not attempt to scrape or/and extract data from the software or mobile applicatons or its database or servers.

Violation may result in immediate suspension or termination of the account.

1.5 Limitation of Liability

Trademark Search Pro is provided “as-is” and “as-available”.

Meerad is not liable for any direct, indirect, incidental, or consequential damages, including:

Delays, errors, or omissions in trademark data

Loss of revenue, business, or goodwill

Unauthorized access to user devices

Subscription fees cover software access only; data update services are complimentary and not guaranteed.

1.6 User Responsibilities

Users must maintain accurate account details, including email and mobile numbers.

Users must export or backup data before subscription expiration or cancellation.

Unauthorized sharing of accounts, credentials, or data is prohibited.

Users must comply with subscription-specific usage limits.

1.7 Acceptable Use

Users may not reverse engineer, tamper with, or misuse the Software.

Marketing or contacting proprietors outside their own trademarks (authorized scope) is prohibited.

Use of Software for unauthorized purposes may lead to account termination.

1.8 Account Suspension / Termination

Meerad may suspend or terminate accounts for:

Violation of Terms

Attempting to scrape or misuse data

Unauthorized sharing of credentials

1.9 Force Majeure

Meerad is not liable for delays or failures caused by:

IP India downtime or policy changes

Government regulations

Technical failures beyond control

Natural calamities

1.10 Arbitration Clause

Any disputes will be resolved first through binding arbitration under the Indian Arbitration and Conciliation Act, 1996.

Both parties would appoint one arbitrator with mutual consent.

Arbitration will occur in New Delhi, India, and the award shall be final and binding.

1.11 Changes to Terms

Meerad may update or modify these Terms at any time.

Users are responsible for reviewing Terms periodically.

Continued use constitutes acceptance of updated Terms
